File a traffic Complaint
WHAT KIND OF TRAFFIC
COMPLAINT DO YOU HAVE?
The Victoria Police Traffic Section is committed to
investigating driving complaints from the public. The public
are our eyes and ears and as such we welcome reports from our
citizens when they observe driving offences that would benefit from
some form of police intervention.
There are three main types of action the police can and will
take when it comes to receiving driving complaints from the
public:
1. GENERAL INFORMATION:
This is general information that you
want us to be aware of for potential enforcement action as time and
resources permit. ie. a continual problem with speeders
in the 30 km/h in Cook Street Village.
For these types of complaints we
will keep track of the number of complaints of a specific concern
at a particular location or area and deploy traffic enforcement
resources in those areas as part of our general traffic enforcement
strategy when resources permit. You will not be
contacted and will not be required to attend
Court.
2. WARNINGS:
These are observed driving offences
where you simply want the police to speak to the driver or owner
and issue a warning.
For these type of complaints we will
generate an investigative file. Providing that you have supplied
sufficiently detailed information we will contact the driver/owner
of the vehicle and express your concerns to them. If warranted they
will be warned that if similar complaints are received about their
driving behaviour they could be ticketed with a fine. In cases
where we are not able to speak to the driver/owner directly we will
send a warning letter to them. Because there will be a
record of your complaint, it assists in starting enforcement action
against the driver/owner should similar complaints be received from
others about their driving offence in the future. Even if those
future driving offences occur in areas outside Victoria or
Esquimalt, your report is helpful as other police agencies will
have access to your complaint about that driver/owner. You
will be contacted with the outcome and you will
not be required to attend Court
3. CHARGES LAID ON YOUR BEHALF:
These are observed driving offences
that you feel warrant immediate enforcement action and you want
police to issue a Violation Ticket on your behalf.
In cases where the police issue a
ticket on your behalf there is almost a 100% dispute rate where the
person getting the ticket wishes to go to court to dispute your
allegations. Because of this, you must be willing
to attend Traffic Court to give evidence to a Justice of The Peace
if required. This may require you to take half a day off work or
school without being compensated to give your evidence. If you
commit to this process and are required to attend Court to give
evidence you will be issued a Subpoena. For these reasons
it is imperative that if you wish police to issue a ticket for an
offence you observed that you are fully committed to the legal
process that may follow. If you can't commit to attending
Court we will not commence enforcement action against another
person on your behalf.
You will be
contacted by the investigating police officer and advised of the
outcome and you will almost certainly be required to attend
Court.
