Results and Release of Infomation from Police Record Checks

The Victoria Police Department releases the results of the Police Record Checks to the applicant only. The applicant is responsible for sharing the information to the requesting agency/employer.

The agency/employer should use the Police Record Check as a part of their screening process and ensure they reduce risks by using a thorough screening/recruitment process, references, training and supervision.

Youth (12 -17 years) records: The Youth Criminal Justice Act requires that the police agency must forward youth information to the applicant only. The guidelines for retention of youth records can be found on various sites on the Internet. It is important that youth understand their rights and that they are clear on the release/disclosure requirement of their records.

If you have information noted in your Police Record Check results as “may or may not exist” in:

Category 1 – Criminal Convictions – you must submit fingerprints to RCMP Ottawa to obtain details of the contents of the Criminal Record

Category 2 – Outstanding Charges/Warrants – check with the agency conducting the police records check for more information

Category 3 – Records of conditional/absolute discharges, stays of proceedings, peace bonds, etc – submission of fingerprints is required.

** It is important to note that conditional discharges are considered a criminal record for 3 years from the date of the discharge**

Category 4 – Local Police files – this information must be obtained through a Freedom of Information request to the police agency that holds the file. Victoria PD will provide a letter with your Police Record Check advising the agency(s) that will need to be contacted.

If you have a Vulnerable Sector Check (search for pardoned sexual offences) conducted and this results in possible information being located you will be required to submit fingerprints and additional consent for release of information to RCMP Ottawa.
